| 摘 要： | 摘要：生活中必有冲突，如何解决这些冲突是问题的关键所在。体育纠纷具有特殊性，通过体育共同体以外的方法来解决体育纠纷，可能出现矛盾的裁决、不公平以及法律的不确定性，这些都影响到裁决的有效性、效力和案件裁决的执行。国际体育仲裁院正是基于此背景下建立的，它独立于任何体育组织或地方政府的独立机构。它通过那些适用于体育领域特殊需要的程序规则以仲裁和调解的方式来解决与体育相关的纠纷，也逐渐成为最公正、最有效、最快速、最具成本效益的体育纠纷解决模式。

| Abstract: | Conflict is part of our daily lives, the critical problem is how to resolve them. Sport disputes is special, the resolution of sports disputes, other than in the context of the sports community, would give rise to contradictory decisions, significant inequalities and a lack of legal certainty with regard to the validity efficacy and enforcement of some decisions. CAS was born under this background. It is independent of any sports organization or local government, which provides services to facilitate the Settlement of sports- related disputes through arbitration or mediation by means of procedural rules adapted to the specific needs of the sports world. It gradually recognized as the fairest, most effective, speediest and most cost effectiv, model for the resolution of sports disputes. |
