| 摘 要： | 自国际体育仲裁制度建立以来，在体育全球化和奥林匹克运动与国际体育的健康发展中发挥了重要的作用，也在中国产生了重要的影响，中国对建立体育仲裁制度进行了从理论研究到立法实践的多方面探索，但这一制度至今尚未建立起来。本文透过没有出现大量体育纠纷外显并激化而威胁正常体育秩序的困局这一表象，分析创建中国体育仲裁制度的现实压力与动力不足的实质原因，是在高度行政化的体育体制下缺乏各权利主体的自治空间，消融着依法维权的意识并掩盖着利益博弈的纷争。本文认为当下中国推进全面深化改革与依法治国的新发展，为建立体育仲裁制度提供了有利的环境和重要的机遇，同时本文对积极进行体育仲裁试行实践和加强多个方面立法提出了有关建议。

| Abstract: | Since the establishment of the international sports arbitration system, it has played a pivotal role in sports globalization and the healthy development of Olympic Movement and the sports around the world. It has also exerted great influence on the sports development in China. The theoretical research and legislative practice for establishing sports arbitration system have been made in China, but the system has not been founded yet. Through the superficial phenomenon that we do not see many intensified sports disputes threatening the normal order of sports, the article discusses the actual reasons why there are not enough real pressure and dynamics in forming sports arbitration in China. Under the system of high administration, the subjects of right lack their own autonomous space, which ablates the awareness of safeguarding rights by law and covers the disputes of interest game. The new development of deepening the reform comprehensively and ruling the country by law has provided favorable environment and important opportunity for establishing sports arbitration system in China. The article also puts forward the suggestions concerning making positive practice of sports arbitration and improving legislation in the relative fields. |
