| 摘 要： | 党的十八届三中全会提出了推进法治中国建设等一系列全面深化改革的新思想、新论断,为我国体育创新发展指明了方向.文章从我国体育发展中存在的现实问题着手,探索了法治体育背景下的中国体育创新发展之路,提出了建立相对独立统一的内部仲裁制度、开展体育立法评估,重视体育“软法”之治,改善特色社会主义体育治理结构、明确政府体育责任,确立竞技体育职业化、市场化发展方向,创新包括运动员在内的体育产业产权制度,建立市场化职业体育运作机制等建议.

| Abstract: | The Third Plenary Session of the 18th CPC Central Committee put forward the new ideas and newdecisions of constructing China’s perfect legal system for further deepening the reform. This has pointed out theway for the innovative development of the sports in China. Based on the practical issues existing in the development,the paper tries to find out a way for the innovative development of Chinese sports under the background ofmanaging sports with law. It puts forward the suggestions of establishing a relatively independent and unifiedinternal arbitration system, starting sports legislation assessment, paying attention to soft-law governance forsports, bettering special socialist sports management structure, defining government’s responsibility on sports,pointing out the direction for the professional market-oriented development of competitive sports, innovating theproperty rights system of sports industry including athletes, establishing a market-oriented professional sportsoperation system. |
