| 摘 要： | 职业体育运动具有不同于普通商业活动和一般竞技体育的特点，它在反垄断法上受到了特殊对待。各国关于职业体育运动的反垄断立法较为原则，而反垄断执法和司法实践则呈现出较大的弹性。职业体育运动所具有的特性在反聋断法实施中得到重视，职业体育运动团体行使合理管理权力的行为往往被豁免适用反垄断法。在发展职业体育运动过程中，我国应当通过立法明确职业体育运动的反垄断政策，有效规范职业体育运动团体的行为。

| Abstract: | Professional sports are treated specially by anti-monopoly law because of the characteristic differences between it and common commercial activities and common sports.In some other countries,the legislation of anti-monopoly law of professional sports is strict whereas the enforcing standards are flexible.The characteristics of professional sports are taken into account during the enforcement of anti-monopoly law.The professional sports leagues are usually exempted from the anti-monopoly law if they use administrative power properly.During the development of professional sports,the anti-monopoly law of professional sports should be defined legislatively,and the behaviors of the professional sports leagues should be regulated. |
