| 摘 要： | 通过文献资料、比较分析等研究方法,从软法视角分析体育产业政策的法律性质、软法表现形式、效力结构等。认为,体育产业政策是体育产业发展的行为准则,它规定和指导着体育产业的发展方向。从法律维度看,作为保障体育产业发展的有效方式与制度形式,体育产业政策本质上是一种具有"组织规则"特质的软法规范、体育领域软法的载体形态,由"权利—职责（权利—义务）"规则、目的性思维、自创性内核等结构性要素组成的体育产业政策对促进体育产业发展起着独特的功能。提出今后我国体育产业政策调整完善需以"良法善治"为准据、提高政策执行能力、健全监督机制、加强绩效考量、确立体育产业政策执行评估机制,以期实现体育产业发展的软法之治。

| Abstract: | Through literature study and comparative analysis, this paper analyzes the nature of law, the expressive form of soft law and the structure of sports Industry policy. Sports industry policy, as the code of conduct in the development of sports industry, plays an important role in regulating and guiding the development direction of sports industry.As an effective way to guarantee the sports industry development and system, sports industry policy virtually is the carrier of sport soft law that contains "organization rules" characteristics of rights and responsibilities, rights and obligations, rules and purposes, which plays a special role to the development of sports industry. In order to realize rule of soft law of development of sports industry, the construction and adjustment of sports industry policy needs to practice legal governance, improve policy implementation ability, perfect supervision mechanism, strengthen performance considerations and establish the sports industry policy evaluation mechanism. |
