| 摘 要： | 采用文献资料法、逻辑分析法等研究方法，以项群训练理论和作品理论为基础，从体育学和法学两个学科视角出发展开研究。研究认为：身体动作、创新性和艺术性构成了项群训练理论和作品理论的逻辑连接点；难美项群竞技体育项目符合我国《著作权法》规定的作品构成要件，具有可作品性，其中，舞蹈型难美项群竞技体育项目和杂技型难美项群竞技体育项目可分别归属于我国《著作权法》中的舞蹈作品和杂技作品。

| Abstract: | This paper studies the event-group training theory and copy right theory through literature research, logical analysis and from the perspective of physical education and law. It is held that the body movements, innovation and artistry are the basic elements of event-group training theory and copy right theory. Skill-oriented sports events go in line with the composition requirements of the works of Copyright Law in China, and can be considered as pieces of works, among which, dance and acrobatics can be attributed to the works of dance and acrobatics according to Copyright Law in China. |
