| 摘 要： | 以发表的《在路上：中国体育法学向何处去》与《刚刚在路上：再论中国体育法学向何处去》为蓝本，探讨了中国体育法学发展问题。近些年，中国主流的体育法学研究存在的一个问题是：未能直面中国的体育法治实践和诸多经验素材，研究语境日渐远离体育实践的现实场景，缺乏对体育法律问题与其他社会现象勾连关系的关注。基于此，笔者阐述了中国体育法学研究中理论构建本土不足、研究主题缺少对中国体育法制现实问题应有关注以及体育法学研究的是体育法律规范还是人及其体育实践等问题。研究认为：体育法学走的是建构理性之路。体育法运作根本上是人的体育实践，我们所要研究的是因体育而生之法，而非制定体育之法。未来中国体育法学发展应直面现实的体育法律现象、规律，可依循一条从实践出发的社科法学进路前行，以扩展研究体育法学问题的知识界限和方法论。

| Abstract: | In recent years, sport law researchers have been unable to face China's rule of law practice and experience of many materials so that the researches have been away from the reality of sports practice. There has been a lack of researches into relationships between sports legal issues and other social phenomena. On the basis of the published papers On the Way: Where to Go About Chinese Sports Law and Being just on the Way: Re-discussion of Where to Go About Chinese Sports Law, this paper holds that the theories of Chinese sports law research were not enough. The topics were not oriented at the practical problems. Whether the focuses should be sports regulations or the relationship between man and legal practice must be clarified. Therefore, the essence of sports law should be rationality based man's sports practice rather than sports rules. In the future, the development of Chinese sports law should face the reality of sports law, using social sciences to extend the study of sports law knowledge and methodology. |
