| 摘 要： | 竞技体育既是我国体育事业的重要组成部分，又是我国体育事业改革中问题最多、推进最难的部分，从法律规制的角度来思考推进竞技体育深化改革的思路及措施具有重要意义。通过文献资料法，对近10年我国竞技体育改革与发展中重大法律问题的相关研究进行了梳理与分析。研究认为，学者们对职业体育市场化改革、运动员培养与发展、运动竞赛行为规范、业余体校改革与发展等方面的法律问题研究，既是对国家发展方针、政策变化的一种积极回应，也是对多年来我国在推进竞技体育社会化和市场化改革中遇到的重大问题在法律层面的思考。研究建议，围绕阻碍竞技体育社会化和市场化改革的重大实践问题，将相关法理性研究视角和观点融入到竞技体育发展的相关立法、司法、执法中，形成具体的制度性文件或法规条例，解决立法的有效性及司法和执法的可操作性等问题。

| Abstract: | Competitive sports are not only the important component in sports field in China, but also the field where there are more difficulties in reform problems and process which means the reform promotion in this field from legal regulation view is of great practical value. Adopting literature study, this paper analyzed key legal issues in competition sports field in China during the past ten years. It could be seen that academic researches on professional sport market reform, athletes foster and development, competition rule and regulation, amateur sports school reform and development were promoted by the government policy changes, revealing the problems in socialization and marketization reform in competition sport field. For the countermeasure, it was necessary to integrate some legal perspective and view into legislation, administration of justice and law enforcement in competition sports development field on some important practical matters in socialization and marketization of competition sports reform, to complete some related regulations or laws, and to solve some problems of legislation efficiency and legal operability. |
