| 摘 要： | 学校体育场馆开放后发生的问题日益增多,管理者是否履行了安全保障义务,关系到是否承担法律责任.对安全保障义务予以界定,阐释设置安全保障义务的法理依据,着重对违反安全保障义务的消极不作为侵权责任进行分析.违反安全保障义务属于消极的不作为,应在合理限度内对该行为进行否定评价,不应让经营管理者因承担责任而经济上遭受重创.过度的否定将使经营管理者的行动自由受到限制,从而加重学校体育场馆经营管理者的责任,妨碍"学校体育场馆向社会公众开放"政策的贯彻落实.
