| 摘 要： | 体育组织章程或规则中规定了强制性的体育仲裁条款，运动员必须承诺遵守该仲裁条款，才能参加相关赛事。从仲裁协议所要求的协商一致的同意要素来看，这种强制仲裁条款存在效力瑕疵。但出于维护体育自治以及高效解决体育纠纷的考虑，各国法院都不会轻易否定体育强制仲裁条款的效力。然而，德国慕尼黑地方法院与高等法院在佩希施泰因案中，对体育强制仲裁条款的效力提出了质疑，引发了国际体育仲裁机制合法性的重大危机。体育强制仲裁条款的社会合法性强于其规范合法性。可以考虑在兴奋剂领域变革意定体育仲裁为法定体育仲裁，或者至少在仲裁条款形式上进行改进，使体育强制仲裁条款能够清楚地为运动员所知悉和理解。根据北京奥运会期间中国最高人民法院对国际体育仲裁机制的支持态度，中国法院会承认体育组织章程或规则中强制仲裁条款的法律效力。

| Abstract: | According to the compulsory arbitration clause in the statutes or rules of sports federations, the athletes shall undertake to comply with the arbitration clause to participate in the sport competition. This kind of compulsory arbitration cause has the deficiency of validity in the respect of the consent element of negotiation agreement. Meanwhile, the state courts around this world seldom deny the validity of the sports compulsory clause because of the consideration of maintaining the sport autonomy and the high efficiency of resolution of sport disputes. But the Munich district and high court in Germany questioned the validity of the sports compulsory clause in the Pechstein case, causing the significant crisis of the international sports arbitration mechanism. The social legitimacy of the sports compulsory clause is much better than its norm validity. The contractual sports arbitration may be reformed to statutory sports arbitration. Otherwise the formality of sports compulsory arbitration clause shall be improved to be easily noticed and understand by the athletes. In the light of the People's Supreme Court's support to the international sports arbitration mechanism during Beijing Olympic Games, State Court in China will recognize the legal validity of the compulsory arbitration clause in the statutes or rules of sports federations. |
