| 摘 要： | 中国共产党第十八届四中全会提出"全面推进依法治国"的重大方略，体育系统深入推进依法治体、依法行政是贯彻"全面推进依法治国"的重大举措。体育行政违法是阻碍我国体育依法行政、实现依法治体进程的重要瓶颈。运用文献资料、专家访谈、案例研究等方法对体育行政违法的内涵和特征进行界定和分析，对我国体育实践中的体育行政违法形态及产生原因进行审视、梳理，在此基础上提出依法行政语境下体育行政违法行为的规制路径。

| Abstract: | The Fourth Plenary Session of the 18th CPC Central Committee deliberated on a draft decision of the CPC Central Committee on "major issues concerning comprehensively advancing rule of law". To comprehensively advance the rule of law, the sports administration system should further promote sports of law and law-based administration. Anti-law-base sports administration is an obstacle to hinder the administration of sports. In this paper, literature study, expert interview and case study were adopted to define the connotations and characteristics of anti-law-based sports administration, to reveal reasons and find ways. |
