| 摘 要： | 体育法是一定社会政治、经济、文化的反映。作为发达国家,日本的体育法也具有某些独特的特点,譬如《日本体育运动振兴法》涉及的体育是为促进身心健康发展而进行的竞技比赛和体育锻炼;体育管理体制是政府与社团相结合的管理体制;《体育彩票法》的出台规范了与体育彩票相关的问题以及募集更多的资金来促进体育运动的发展;而在体育运动商业化方面,职业运动员合同、俱乐部会员合同等是典型的表现;至于解决体育争议,则有日本体育仲裁庭进行仲裁。我国在某些方面也应当借鉴日本体育法制的某些做法,修改、完善我国的体育法制度。

| Abstract: | Sports law is the reflection of social politics, economy and culture. As a developed country, Japanese sports law has also some peculiar characters, for example, Sports Promotion Law encourages the sports competition and physical exercise for healthful development; sports administration system is a combined system between government and social entities; Spots Lottery Law regulates sports lottery and public gambling, and promotes sports development through raising more and more funds; while in the case of sports commercialization, professional player contracts and club membership contracts are the representatives; as to the resolution of sports disputes, there are sports arbitration court. |
