| 摘 要： | 本篇论文对我国体育彩票的法律规制问题进行了研究。研究表明:我国体育彩票在取得相当业绩的基础上,存在一些突出问题。这些问题具有深刻的制度面成因,主要是现行监督管理体制和发行体制的重重弊病以及体育彩票管制规范基础的薄弱。提出在构建和谐社会理念下,我国体育彩票的规制改革应当着力于体育彩票管制正当性和效率性双重考量。具体而言,应当以市场化为导向改革发行体制,以独立化为目标组建新的监督管理机构,从各个位阶补足体育彩票监督管理体制的规范,并在监督管理过程中引入公众参与,促进我国体育彩票的法律制度建设。

| Abstract: | With the research methods of the combination of documentary analysis,interview and synthetic and analysis etc,to do research on questions law regulations of sports lottery in China.The research shows that sports lottery in China achieved greatly and has earned itself exist serious the reputation problems.However,serious problems also exist institution of the sports lottery,mains are layer upon layer malady and weak of the sports lottery control standard base of present supervise the management system and the issuing system.It has Putting forward under the guidance of the idea establishing a harmonious society,the reform of regulations in China's sports lottery should take both justness and efficiency into account in formulating the sports lottery regulations.In practice, we should reform the issuing system in line with market orientation by bringing in business mechanism.It is necessary to form independent new supervise the management organs,increase regulations in sports lottery at all levels and introduce public participation procedure during the course of supervise the management,in order to promote law system build of sports lottery in China. |
