| 摘 要： | 传统的法律理论主要是围绕国家法而展开的。主权国家制定的国家法和国家政府间形成的国际法是法学研究的主要对象。当世界迎来全球化时代后,在全球层面产生了一种新的法秩序——"全球法"。这种法秩序突破了国家与法之间那种传统意义上固有的联系性。然而,这种突破了传统法律理论的法秩序在缺乏新的理论阐释的情况下举步维艰。对于全球法的论证,以往的研究都是以"Lex Mercatoria"作为例证进行研究。随着体育全球化成为一种客观事实,体育法治全球化正在孕育着一种新的全球法类型——"全球体育法"。主要采用文献资料调研、比较分析法、逻辑分析法等方法首先按照"万民法"——"国际法"——"跨国法"——"全球法"的历史发展脉络考察了"全球法"的出现,并阐述了"全球法"的基本形态和范例;其次,分析了"全球体育法"产生的可能性。第三,对论证"全球体育法"合法性的方法进行了考察,并最终采用Gunther Teubner论证"Lex Mercatoria"的方法来论证全球体育法的合法性;最后对"全球体育法"的形态进行了初步的探讨。研究旨在为"全球法"的研究引入"全球体育法"这一新的例证,并为开启"全球体育法"领域的研究起到投石问路的作用。
