| 摘 要： | 我国体育法学研究始于20世纪80年代中期,并以20世纪末21世纪初为界分为两大阶段,从第1阶段偏重体育立法研究而忽视体育中现实法律问题的探讨,到第2阶段深入体育实践中的问题,重视体育主体权利义务的研究,并在近年取得了一定进展.简述了我国体育法学研究取得的主要成就,认为我国体育法学研究存在学术积淀贫弱与学术批判缺乏,研究人员匮乏学派尚未形成,学科体系模糊与教材结构性失调,过分侧重制度性研究受法系因素与法学母学科限制等问题.新形势下,需要重新审视对体育法学的理论研究:体育法是决定体育领域中法律关系结构及产生于体育活动中的问题的一种法律,既包括国家对体育进行管制的法律规则,也包括体育运动当事人创造的用以调整彼此之间体育关系的规则;应对体育法概念中的"体育"做广义理解;体育法学是法学的独立分支学科,其应用性显著;体育法学研究对象是产生于体育实践中的包涵体育法律事实与体育法律价值的法律问题;体育法学作为学科的雏形应来自于两部分:本学科的基本理论问题(总论)和与实践相关的专门问题(分论).
