| 摘 要： | 通过对中、外体育社团处罚纠纷处理机制的研究，认为体育社团纠纷处理机制中行政复议和行政诉讼方式不可取；体育社团应具有内部救济途经；内部救济不能排除法院最终审查权。据此，提出了体育社团处罚纠纷处理机制三层次保障的建议。

| Abstract: | Through studying mechanism of dispute punishment in sports association at home and abroad,the author thinks that the method of administrative review and administrative proceedings cannot be replaced in sports association dispute punishment.Sports association should have approach of internal helping,but cannot get rid of final examination of court.Based on it,suggestions of three levels of security on dispute punishment of sports association were put forwarded. |
