| 摘 要： | 通过对中国现阶段的体育法制与西方国家体育法制的比较，讨论了我国现行体育法制中关于公民体育权利的保障、运动员的权利保障和体育安全保险、竞技体育的职业化、体育法制中的司法程序、体育产业的监督管理立法等方面存在的问题，结合我国加入WTO和我国即将举办2008年奥运会的历史大背景，对以上问题提出了对策。

| Abstract: | With the comparison of the sports legal system at present in China and that of the western countries, it has made a discussion of such existing problems as the guarantee of citizen's sports right in the current sports leyal system of China, the athlete's righe and sports security guarantee,the competitive sports professionalism, the judicial procedure of the sports legal system, the supervision and legislation of sports industry. with the combination of the historical backgrounds of the entry to WTO and the holding 2008 01ympic Games in China, it has put forward some countermeasures to the above problems. |
