| 摘 要： | 运用产权经济理论和法学的相关观点,论证建立不属于知识产权法保护范围的、专属体育赛事主办方的创意产权制度,即"准专利"制度的必要性,从实际案例、法律、经济学角度分析建立体育赛事创意产权制度的可行性。认为:建立创意产权制度有利于增加创意的供给、降低体育赛事创新风险,是当前普遍采用的行政主导模式的重要补充。

| Abstract: | The theory of property right economy and the related viewpoints of science of law were used to demonstrate the necessity of setting up a creative-idea property right system,i.e.the system of "quasi-patent",which was beyond the protection of knowledge property right,and belonged only to the sponsor of sports competitions,and to analyze the feasibility of establishing a creative-idea property right system of sports competitions from the angles of real cases,law and economics.It believes that the establishment of a creative-idea property right system is good for increasing the supplies of creative idea,decreasing the risk of sports competition innovations and is an important supplementation of administrative dominant model used commonly at present. |
