| 摘 要： | 以电子竞技职业选手的权益保障、违规处罚与申诉救济为核心，在详细考察其中存在的问题并与传统体育/竞技项目比较的基础上，尝试构建周延的电子竞技职业选手规则体系。认为：在权益保障方面，注册管理制度有助于将电子竞技职业选手纳入国家运动员的统一管理，最低薪酬保障和工资帽制度有助于选手工资的相对均衡，加强合同监管则有助于合同条款与选手权益相一致；在违规处罚方面，电子竞技规则中行为和罚则对应关系的设定、各类规范中欠缺事项的补充，以及对选手日常行为管控的细化等急需进一步完善；在申诉救济方面，无论是合同争议还是违规处罚争议，在确保联盟优先救济的同时，积极利用并开拓仲裁和诉讼等外部途径，是确保争议得到公正处理的必由之路。

| Abstract: | Focused on the three-dimension of right and interest protection,violation punishment,and appeal and relief as the core,the establishment of rule system for professional e-sports players are explored,compared with other traditional sports events.It holds that registration management will help to include e-sports players into the unified management system for Chinese athletes nationwide as to the protection for rights and interests.The minimum wage security and salary cap systems will ensure relatively balanced salaries of players.Reinforced contract regulations will safeguard the rights and interests of players agreed in contracts.On violation punishment,it is of vital importance to make improvement on how to set rules for behaviors and the corresponding punishment,to supplement what has been neglected and reinforce the management and control to routine behaviors of players.As to appeal and relief for either contract disputes or violation punishment disputes,relief from the e-sports league should always be prioritized.And meanwhile,other external channels like arbitration and lawsuit should also be used to guarantee disputes can be resolved impartially. |
