| 摘 要： | 辨析体育协会改制后其法律主体地位的重构及监察范围的重新界定,在此基础上讨论体育监察体系的重塑。认为:尽管体育协会改制后实现管办分离,成为具有独立法律地位的社团法人,但改制后的部分协会仍属于行使公权力的社会组织,协会内部公职人员应纳入监察监督范围。体育协会监察范围的确定可以公权力和自治权的边界为主线,结合权力来源和依据、专属性和开放性等标准,在个案中进行综合判断。体育监察体系应以平衡体育自治与监察监督为基本原则,进一步更新监察法律规范,以权力清单明晰权力和监督边界,构造综合性体育监察体系,建立高效的体育腐败监察调查机制。

| Abstract: | The reconstruction of the legal role was explored after the decoupling reform of sports associaions,and the redefining of supervisory system.It holds that sports associations still belong to the social organizations which implement public authority,therefore their inner members are supposed to be the targets of supervision system,though these organizations become independent associations after the separation of management and operation.Dividing the boundary of public power and autonomy power is the key to clarify the scope of supervision,by integrating the origin,base of power,as well as the specificity and openness as the general standards.The supervision system in sport should base the principles on the balance in sport autonomy and external supervision.And the supervision legal system should be consistenly upgraded,thus the power boundary will be clear with the help of power list,and a comprehensive supervision system and efficient investigation model should be established against the corruption in sport. |
