| 摘 要： | 结构主义与行为主义是反垄断立法上很重要的一组概念,也是垄断控制制度的基本分类。在区分已经形成垄断地位和正在形成垄断地位的两个领域中,结构主义与行为主义的侧重点有所不同。文章对其原因进行分析后,指出结构主义与行为主义有融合的趋势,并阐述了这种趋势对我国反垄断立法的启示。

| Abstract: | The structural principle and the proceeding principle are the most important concepts in the antimonopoly law. They are also two basic kinds of monopoly control system. In the two areas where monopoly has formed and monopoly is forming, the antimonopoly law puts differently emphasis on structural principle and proceeding principle. Furthermore it is pointed out that there is a tendency of merging for the two principles. And the tendency can direct us to constitute the antimonopoly law with a more rational attitude. |
