| 摘 要： | 数字图书馆建设的诸多环节无一不受到知识产权制度的制约,这与知识产权制度的初衷相背离。应当以长远的目光、站在人类社会协调可持续发展的角度,回溯知识产权制度的真正目的,协调公平与效率、个人权利与社会利益的关系,在一定程度上适当、合理地限制知识产权保护的壁垒,做到保护产权人利益、激励创新的同时,兼顾社会公众享受公共信息资源的权利。

| Abstract: | The construction of any part of the digital library can hardly avoid the restriction of the intellectual property rights,but it＇s far away from the original intention of the intellectual property rights.On the basis of sustainable development of human society,we should have a long-range vision to review the purpose of the intellectual property rights,coordinate the relationship of fairness and efficiency,the rights of individuals and social benefits.To a certain extent,the barriers of the protection of the intellectual property rights should be restricted,so that,not only can we protect the right of the property man and reward the innovation,but also can give attention to the public rights of enjoying public information resource. |
