| 摘 要： | 公民信息权是信息社会形态的公民的一项基本权利,文章探讨了信息社会公民信息权的定义与性质,认为"公民信息权"的概念是伴随着社会信息化程度的日益提高与信息社会化而产生的新概念,具有高级形态的生存权与发展权的性质.信息权的内容主要有信息自由权、个人数据权及信息财产权,分别构成公民在信息社会中的生存权、发展权、安全权及财产权.公民信息权利指向的客体是特定的信息资源,而非所有的信息资源.同时指出,公民信息权的行使与权利救济方式,提出公民在获得信息权利的同时也要履行相应的义务和责任.

| Abstract: | Information rights are basic rights of citizens living in information era.This paper discussed the definition and properties of citizens' information rights in information era,considering that the concepts of information rights are new ones came into being with the increasing the degree of social information and the information society,which nature have advanced form of survival and development rights.Information rights consist of information freedom rights,personal data rights and information property rights,they are the rights of living,development,safety and property for citizens living in information era.The objects of information rights are specific information resources,not all that.At the same time,this paper pointed out the performance and remedy methods of information rights,and provided that citizens should fulfill corresponding obligations when enjoying the information rights. |
