| 摘 要： | 如何在专利保护和防止知识产权滥用之间寻找适度平衡,一直是各个国家面临的现实问题.完善的专利保护制度和反垄断制度相互配合.对于促进技术创新、保障市场竞争有序具有不可替代的作用.本文以问题专利为出发点,探讨保护和反垄断之间的同一性和对立性,建议从立法、司法、鼓励政策和增强公众认识四个方面完善我国的专利保护机制.

| Abstract: | How to reach suitable balance between patent protection and avoiding abuse of knowledge property, is a common problem that every country is facing. The mutual cooperations between patent and anti-monopoly institutes have important roles, which could promote technology innovation and ensure ordering market competiton. From the view of problem patent, this paper researches the characteristic of identity and antinomy between protection and anti-monopoly, suggests consummate patent protection mechanism from the aspects of legislation, judicatory, encourage policy and boost up public cognition. |
