| 摘 要： | 分析了集成创新中知识产权侵权风险的成因,发现技术上的追赶地位和集成创新的特点是诱因,企业知识产权意识和管理水平不足是直接原因,而竞争对手利用知识产权进行牵制或者谋求经济利益则进一步加剧了企业面临的知识产权侵权风险；然后从三个方面提出了集成创新中知识产权侵权风险的防范策略；最后,应用提出的框架对华为和思科间的知识产权纠纷案例进行了分析.

| Abstract: | The paper analyzes the formation mechanism of intellectual property infringement risk in integrative innovation.We find that status of technology pursuit and characteristics of integrative innovation are inducements,and the lack of intellectual property consciousness and management skills is the direct reason.Furthermore,competitors constraining the firms or capturing economic profits through intellectual property competition exacerbates the intellectual property infringement risk the firms face.Then,this paper puts forward countermeasures of intellectual property infringement risk in integrative innovation from three perspectives.At the end the paper,we use the framework put forward here to analyze the legal dispute between Cisco and Huawei. |
