| 摘 要： | 目的/意义]大数据时代下,跨境数据流动已经变得越来越频繁。通过对中美跨境数据流动进行专门研究,有助于提高中美跨境数据流动安全水平,促进两国数据跨境流动。方法/过程]在构建PISEL博弈模型分析框架的基础上,采用演绎分析法和比较分析法,对中美两国如何做出跨境数据流动决策以及如何进行跨境数据流动风险治理进行研究。结果/结论]研究发现,在既有信息条件下,中美基于自身利益最大化原则,分别采取了本地存储型和宽松型跨境数据流动立法。跨境数据流动在增进中美两国经济收益、社会收益的同时,也带来了一系列跨境数据流动安全问题。由PISEL博弈模型分析框架可知,中美跨境数据流动风险治理要想取得实质性进展,就必须以参与者(P)和信息(I)两要素为抓手,从增强国家大数据资源意识、加强两国合作、借助PPFEITSF智能跨境数据流动风险治理模型这几个方面进行突破。

| Abstract: | Purpose/Significance]In the age of big data,cross-border data flows have become more frequent.Through specialized research on cross-border data flow between China and the United States,it will help to improve the security level of cross-border data flow between China and the United States and facilitate the cross-border movement.Method/Process]Based on the analysis framework of PISEL game model,this paper uses deductive analysis method and comparative analysis method to study how to make cross-border data flow decision and how to carry out cross-border data flow risk management in China and the United States.Result/Conclusion]The study found that under the existing information conditions,China and the United States have adopted local storage and loose cross-border data flow legislation respectively based on the principle of maximizing their own interests.Cross-border data flows,while enhancing economic returns and social benefits between China and the United States,also bring about a series of cross-border data flow security issues.The analysis framework of PISEL game model shows that in order to make substantial progress in cross-border data flow risk management between China and the United States,we must take the two elements of participant(P)and information(I)as the grasp,from enhancing the awareness of national big data resources,and strengthen the cooperation between the two countries,through the PPFEITSF intelligent cross-border data flow risk management model to make a breakthrough. |
