| 摘 要： | 当前我国市场经济体制建设尚不完善，劳动关系双方力量对比失衡，导致职工的合法权益受到严重侵害，迫切需要工会积极履行维权职责，发挥其利益代表者和维护者的作用。然而，目前我国工会在职能定位，履行其维权职责等方面还存在一些问题，比如：工会组织的行政化、农民工边缘化、工会主席角色错位等等。本文从工会的性质、目前我国工会的困境以及工会摆脱困境的对策等方面进行了讨论，试图理清我国工会职能和维权方面较为合理的可行的思路，但也难免会存在观点、方法有待商榷的问题。

| Abstract: | Currently, China＇s market economy system is still im-perfect, and the strengths of the two labor parties are imbalanced, resulting in the serious damage of employees＇ legal rights, so it is urgent that the labor unions perform their responsibility of legal rights safeguard and play their role as an interest representative and advocator. However, there are still some problems in the function positioning and responsibility performance of the present China＇s labor unions, such as the administrationalization of labor union organizations, the marginalization of migrant workers, the role dislocation of labor union chairmen, etc. This paper discuss-es the properties of labor unions, the predicaments of the present China＇s labor unions and the countermeasures to overcome the predicaments, attempting to clarify relatively rational and feasible ideas of the functions of China＇s labor unions and the safeguard of legal rights, but inevitably, there will be some debatable views and methods. |
