| 摘 要： | 基因专利的出现，一方面对专利制度的传统理论提出了挑战，人们不得不对有关理论进行修正，如发明与发现的界定，“三性”的认定问题等，另一方面，使得专利制度作为促进经济发展的工具的特性更为突出，各国竞相建立自己的基因专利制度，并在世界范围进行基因专利争夺，针对这些形势，我国必须采取相应的对策。

| Abstract: | Gene-related Patents is the product with the development by the modern biotechnology industry and Human Genome Project. With the emergement of Gene-related Patents, patent law give its characterisation as a tool of economic regulation clearly. Men have to revise some theories about the patent. Although there are controversies on the Gene-related Patents , most countries are seizing the Gene-related Patents actively. China have to carry out some suitable seizing tactics. |
