| 摘 要： | 针对互联网上不断出现的知识产权纠纷,网络知识产权应运而生。网络知识产权除了与传统知识产权在客体范围和客体特征上存在区别外,二者在内涵上具有同一性。然而,赋予权利人以网络知识产权这一专有权的正当性问题值得思考。以激励论和利益平衡论为视角,通过对相关理论的阐述和借鉴,试图论证网络知识产权的正当性,进而推动网络知识产权本质认识的深化。Abstract：Internet intellectual property emerges as the intellectual property disputes arise frequently on the Internet.Internet intellectual property and the traditional intellectual property have the same connotations except for the differences in the scope and feature of the object.However,the justness of endowing the obligee with a special right,that is,Internet intellectual property,is worth thinking.From the perspective of incentive theory and benefit balancing theory,this paper expatiates on and draws lessons from the relevant theories,and tries to prove the justness of Internet intellectual property so as to deepen the understanding of the nature of Internet intellectual property.
