| 摘 要： | 知识产权制度几乎与近代科学技术同步兴起,其产生与发展对技术创新产生了重要的激励和推动作用。世界各国纷纷加强知识产权来保护其技术创新的发展。然而在加强知识产权保护的同时,它所带来的经济与社会方面的消极影响也是不可忽视的。学术界关于知识产权对技术创新的促进和激励作用的相关研究已经很多也比较深入,但关于知识产权对技术创新的负面作用的研究则很少。本文针对国内外有关知识产权对技术创新的消极影响的相关文献进行综述和理论评析,为全面客观地认识知识产权制度对技术创新的影响提供辨证思考,在此基础上指出进一步的研究思路和相关问题的解决途径。
