| 摘 要： | 随着6C等专利联盟对中国DVD行业收取巨额专利使用费，专利联盟这一经济实体已引起了学者们的关注。本文从促进和阻碍技术创新等两个方面对专利联盟的微观机理进行研究，结果表明：专利联盟可通过清除技术研发过程中的专利障碍、降低专利交易成本等作用的发挥促进技术创新和经济发展，但却通过竞争性专利技术的打包许可、无效和未专利化技术的免费搭便车等行为对技术构成了不应有的垄断，从而阻碍了技术进步和经济发展。

| Abstract: | With the imposing a great deal of patent royalty on the DVD industry in China by the patent pool,such as 6C and so on,the scholar have been giving attention to the Patent Pool.This paper study the microcosmic mechanism of the patent pool from the aspect of the facilitating and blocking technology innovating.The paper show that Patent Pool not only promote economy developing and technology innovating through clearing patent obstacle of R&D,reducing transaction cost of patent and so on,but also block economy developing and technology innovating through packed licensing competitive patent,riding freely by invalidate patent and unpatented technology. |
