摘    要:土地承包经营权流转顺畅亟需科学、系统的流转价格评估体系。以农用地价值构成为理念,借助于土地使用权评估的基本方法,用土地承包经营权的权属特性进行修正,构建了土地承包经营权流转价格模型,并以沁阳市西万村为典型村域进行了实证分析。结果表明,土地承包经营权流转价格应该包括经济价格、社会价格和修正价格。价格模型的应用,应甄别理论价格和实际流转费用的区分,农用地流转后经营项目没有转变,流转价格为经济价格和社会保障价格之和。农用地流转后经营项目发生转变,比如耕地改种经济作物,流转价格则是经济价格、社会价格与修正价格三者的总和。收益分配格局存在复杂性,流转收益应在国家、村集体经济组织、流出方、流入方和管理者之间合理、公平分配。

Abstract:Agriculture, countryside, and peasant problems have been three challenges China is being faced with. The fundamental measure of resolving these issues is developing rural productivity. The land use policy reform is the major method of solving these problems. The Communist Party of China and the government permit the transfer of land contract and management rights in various forms and develop a variety of forms for appropriate large-scale operation. Land contract and management rights are usufructuary rights from agricultural land, which exist in economy, society, and the environment through transfer market allocation. The current price evaluation system lacks a systematic and reasonable price assessment of transferring land contract and management rights. This drawback has weakened market resources allocation, slowed down the market allocation of land resources, and hindered optimal land resources allocation. Smooth transferring land contract and management rights necessitates a scientific and systematic assessment system of the price. Based on principles of agricultural land value in constitution and land use rights assessment of the basic approach and characteristic correction of land contract and management rights, the authors built a transferring pricing model, and applied it to Xiwan village that is typical agricultural areas in China. Results show that transferring price of land contract and management rights should involve economic price, social price, and corrected price. The three prices were calculated using different methods. Empirical analysis shows that the transferring price calculated by the model appears reasonable and affordable by the outflow side. The use of the price model should account for the distinction between theory and practical application if there is no change in management projects, i.e., agricultural management projects remain invariant, continuing to grow food crops; the transferring price is therefore the sum of economic price and social security price. If there is a change in management projects, e.g., converted into economic crops, the transferring price should be the sum of economic, social price (including social security price and social stability price), and corrected price. Because of the complexity of transfer income distribution, from the Marx land tax theory, it is indicated that a country should allow transferring gains equitably and rationally distributed in the country, the village collective economic organizations, outflow side, inflow side, and management.
