摘    要:不符合规定途径的农村集体建设用地流转现象在现实中大量存在,但建立城乡统一的建设用地市场却受到了很大阻碍。本文以北京市为例,研究农村集体建设用地流转中的利益主体即地方政府、村集体、农民和用地方,发现导致流转的根本原因是各利益主体的利益驱动,各利益主体间均存在利益冲突,并从利益主体的视角分析导致农村集体建设用地流转利益冲突的深层次原因,认为地方政府与村集体之间的利益冲突为主要矛盾,政府协调好各方之间的利益冲突是推动农村集体建设用地入市流转的关键,提出应从完善村集体经济组织的主体地位,明确地方政府职能,协调利益主体之间的收益分配,运用行政手段为统筹城乡经济发展服务等利益协调策略,为构建城乡统一的土地市场提供决策参考。

Abstract:Informal transfer of collective construction land is common in rural areas in recent years;however,the work of building a uniform market of rural-urban construction land remains impeded. Using Beijing as a case study,we looked at the underlying reasons hindering the market allocation of rural collective construction land from the view of stakeholder analysis. Informal transfers of collective construction land are increasing quickly in rural areas of Beijing and there are six types,among which renting is the most common. The occurrence of informal transfer of collective construction land is closely related with its location. After a survey of transferred cases, we believe that there are four major stakeholders in the transfer process:local government,village peasant collective,peasants,and land users. The interests of these stakeholders are the major reason driving the informal transfer of collective construction land. We go on to explain the conflict-of-interest among them,and found the conflict between local government and peasants is the most important. The underlying reasons of these conflicts-of-interest include the vagueness of property rights,the multiple identity of government and imbalances in regional economic development. We suggest methods for building a uniform rural-urban land market. First and foremost,the government should coordinate the conflict-of-interest among different stakeholders. Second,the government should entrench the dominance of village collective economic organization and specify the functions of local government. Third,the government should coordinate the allocation of profit among stakeholders and generate strategies to balance urban and rural economic development services through administrative means.
