| 摘 要： | 美国State street bank案之后商业方法专利频繁出世。商业方法专利并不是新兴产物，它的出现不但与美国的重视知识产权政策和战略有关，还与飞速发展的计算机技术和网络技术、电子商务体系息息相关。尽管美国、日本和中国在商业方法专利的分类上稍有不同，但是，商业方法专利的特征却有其共通性。商业方法专利给世人带来的是专利意识的革命。

| Abstract: | Business method patents emerge frequently after case of State street bank in USA. Business method patent is not a new product, its appearance is not only related to United States valuing intellectual property rights policy and strategy , but also the rapid development of computer and network technology, e -commerce system closely. Although the classification of business method patent is slightly different in United States ,Japan and China, the characteristics of business method patent have a lot in common. What business method patents bring is the revolution of patent consciousness. |
