| 摘 要： | 格式合同的行政规制，是指行政机关依照法律规定对格式合同的内容进行规范，对格式合同的使用进行监督检查，从而防止和消除不公平格式条款的活动。由于行政规制具有主动、高效、涉及面广等诸多优势，因而通过行政手段对格式合同进行规制受到各国的重视。就我国目前格式合同行政规制的现状来看，存在着主体分散、部门保护、方式方法单一等缺陷，导致大量不公平条款轻易出现在格式合同中，为此，需要组建专门的、中立公正的格式合同审查机构，并综合利用公开听讧等多样化的方式，加强对格式合同的审核和监督检查，以切实发挥行政规制的功能作用。

| Abstract: | Administrative regulation of standard form contract refers to the executive authorities in accordance with the law to regulate the content of the contract, to supervised and inspect the use of standard form contract in order to prevent and eliminate unfair terms. Administration regulation has a lot advantages , it is active and efficient, covers a wide range, so it draws various countries＇ attention. So as to administrative regulation of standard form contract in China, there are many defects, such as subject dispersed, department protection and means of a single , resulting in a large number of unfair terms in contracts easily appear in the standard form contract, so it is need to establish a neutral and impartial review body, At the same, integrated use of a variety of ways such as public hearings to enhance the review and inspect standard form contract in order to exert effective regulatory system administration function. |
