| 摘 要： | 随着我国《政府信息公开条例》的颁布与实施,各地法院先后受理并审理了多起政府信息公开行政诉讼案件,但是从案件的受理、审判到结案,各个环节都显示出法官们对政府信息公开行政诉讼案件认识上的分歧.因此,从理论上对政府信息公开行政诉讼予以梳理,统一认识,以指导我国政府信息公开行政诉讼案件的受理与审判是非常必要的.但限于篇幅,作者仅以对政府信息公开行政诉讼案件起指导作用的基本原则作一分析与探讨.作者认为,基于政府信息公开制度的价值取向,从保护公民知情权、促进政府信息公开的角度,政府信息公开行政诉讼的基本原则应该体现在以下几个方面:人权保护原则、利益衡量原则、及时原则以及不公开审查原则.

| Abstract: | Along with "the Regulations of China on Freedom of Information" being enacted and come into effect,local courts have accepted and heard a few cases of administrative proceedings about government information publicity early or late.But from accepting and trying to settling these cases,it seems that there are some cognitional divergences among judges to administrative proceedings about government information publicity in every judicial link.So it is very necessary for us to theoretically systemize administrative proceedings about government information publicity and to unify cognitions in order to direct us to accept and try cases of administrative proceedings about government information publicity.Being subjected to the length of the article,the author only makes an analysis and discussion on principles which is very instructive for us to try cases of administrative proceedings about government information publicity.The author believes that,in view of the value orientation of the government information publicity system and from the angle of protecting citizens’ the right to know and promoting government information publicity,the basic principles of administrative proceedings about government information publicity should be reflected in followings: the principle of protecting the right to know,of weighing different interests,of timeliness,and of non-opening examination. |
