摘    要:随着城市房屋商品化的发展以及机动车的普及,商品房小区停车位不足的问题渐渐突出,小区停车位的归属和性质成为重要的法律问题。小区停车位在法律性质上属于建筑物区分所有权中的共有权。《物权法》对共有权的范围进行了原则性的规定,但基于共有权产生的纠纷颇多,特别是小区停车位、车库的纠纷日益增多,有必要对建筑物区分所有权中的共有权范围进行梳理,提出处理小区停车位纠纷的原则。
