| 摘 要： | 从单项专利和机构专利两个方面研究了专利质量的内涵外延,提出了单项专利和机构专利质量测度的方法和指标体系。认为专利质量是专利技术水平高,撰写较好,能够经得起审查、无效和诉讼程序具有较大市场价值的专利,本质是专利满足专利三性即新颖性、创造性和实用性的程度。对单项技术来说,专利质量必须同时满足技术质量和法定质量,两者缺一不可。对机构来说,除测度技术质量和法定质量外,还要测度专利实际产生的价值,专利质量是指专利技术质量、法定质量和经济质量的总和。
