| 摘 要： | 在技术标准化合作中,交叉许可的知识产权分为基本的和非基本的两大类。其中,起关键作用的是基本知识产权,它们是技术标准发展与联盟网络的关键要素与瓶颈。与此同时,主导企业的知识产权战略及其行为对标准化合作也有着重大影响。基于GSM案例研究,揭示基本知识产权的这一作用过程与机理以及主导企业的战略影响。

| Abstract: | There are two kinds of intellectual property rights (IPRs) in technological standardization cooperation: essential Intellectual Property Rights and non-essential Intellectual Property Rights. It is essential IPRs that play a crucial role in the cooperation process, which is the essential facility and conduit in the development of technological standards and alliance networks. At the same time, the IPRs strategy and behavior of the dominant companies have significant influence on cooperation in technological standardization. Based on the GSM case analysis, this paper reveals the process and mechanism in which essential Intellectual Property Rights is located, and the strategic effects of dominant companies in technological standardization, which have important explanatory power and policy implications for exploring the strategic approaches to exploiting e-IPRs, developing technological standardization, strengthening industrial competence in China. |
