| 摘 要： | 目的/意义]旨在探索科技迅猛发展的环境下数字图书馆适用著作权合理使用制度的开放路径。方法/过程]阐述了合理使用制度的理论基础,分析了现有合理使用制度下数字图书馆建设的困境,最后提出构建适用于数字图书馆的合理使用制度之开放性路径的立法和司法建议。结果/结论]为保障数字图书馆在信息网络时代实现其公共服务的社会职能,建议在立法上增设合理使用的一般条款,并在司法上推行案例指导制度,以实现适用于我国数字图书馆创新发展的合理使用制度之开放性拓展。

| Abstract: | Purpose/significance]The paper aims to explore the path openness of fair use which is applicable to libraries.Method/process]The paper explains the theoretical basis of fair use analyzes the dilemma of digital library construction under the current fair use system and puts forwards the legislative and judicial proposals on fair use openness suitable for the development of digital libraries.Result/conclusion]To guarantee the digital libraries to achieve social function of providing public service in digital network time the paper proposes that it can add a general clause in legislating and meanwhile implement case-guiding system in judicature so as to realize the path openness of fair use system applicable to the innovative development of digital libraries in China. |
