| Abstract: | It firstly introduces the concepts of gene patent and patent pool.In succession,it discusses three sorts of possible gene patent pools: Gene diagnoses patent pool,gene medicament patent pool and DNA chip patent pool.Then it analyzes the benefit of gene patent pool.At last,it discusses the restriction of misuse of gene patent pool from three aspects: Basic principle,patent law and antitrust law. |
