| 摘 要： | 本文从激励创新和促进经济增长两个方面考证专利制度的绩效，在理论论证的基础上，就中国专利制度运行中的相关数据进行了全面的实证分析。结论表明，专利制度的绩效与制度的完善程度是关联的，现阶段对我国专利制度的完善应重视对原创性技术的倾斜及对专利技术商业化环境的完善。

| Abstract: | On the basis of theoretical demonstr ation of a legal system' s utility,the paper makes an overall eval-uation on the performance of China' s patent system since its foundation.The empirical analysis shows that t here is a close correlation between the numb er of patent grants and the GDP of a nation.In addition,utility models and designs have a remarkable impact on C hina' s economic development while the imp act of inventions is tiny.The author indicates that the present em phasis in the perfection of China' s patent system and other relevant policies should be placed on original technology and high technology.Meanwhile,it is also essential to better the com-mercial environment,in which paten t technology is utilized. |
