| 摘 要： | 土地是农民休养生息的命根子,土地财产权是法律赋予农民的一项不可剥夺的私权,保护农民土地财产权是破解"三农"问题的起点。土地储备制度在一些地方侵犯了农民的土地财产权,现行征地制度和保护农民土地权益的法律也在一定程度上滞后于经济社会发展,所以,必须加快土地管理法规体系修改的进程,完善对失地农民的征地补偿和安置制度,运用物权法来保护失地农民的土地权益。

| Abstract: | Land is the lifeblood of peasants and land property right is an unalienable personal right endowed by law.So the protection of this right is the solution to the problem of agriculture,village and peasants.Land reserve system in some places infringe peasants land protection law to some extent Lag behind social economic development.So we should enforce the law of land management,establish the system of land requisition compensation and placement,and protect the land interest of peasants who lose their land. |
