| 摘 要： | 人类社会中＂自发秩序＂与＂建构秩序＂的对立和发展构成了哈耶克的社会秩序二元观。当前中国政府建构型工会制度与产业工人自发要求的工会制度越来越成为社会经济生活中的显性矛盾。依据哈耶克分析框架,中国工人自发的工会变革要求必然对政府的建构工会制度形成修正压力,中国工会制度应沿着自发制度要求的方向实现工会去行政化,改变工会现有的财务模式,积极搭建工资集体谈判机制的平台,允许私营企业工人有罢工权。

| Abstract: | The contradiction and development between ＂spontaneous order＂ and ＂constructive order＂ form Hayek＇s duality viewpoint of the society order.In current China,the contradiction between the government＇s constructive unionism and the unionism of workers＇ spontaneous demand is becoming increasingly obvious.Based on Hayek＇s analytical framework,worker＇s spontaneous-demanded unionism will inevitably impose amend pressure to the constructive unionism.China＇s unionism should develop along its spontaneous-demanded path： to achieve the de-administration in unionism,change its current financial pattern,positively construct the platform for collective bargaining over salary,and endow private enterprise workers with the right to strike. |
