| 摘 要： | 市场化是中国法治化的根本动力。市场化培养着法治的、有着广阔活动与价值选择空间的自主的个人和多元化的、自主的社会组织和社会团体，从而培育着市民社会，创造着一支从外部约束政府的经济力量，推动着市民社会与政治国家的分离和互动。全球化使政府的他律力量进一步加强。政治层面的民主政治建设和政治体制改革是中国法治化的关键因素，直接推动着法治化的进程。中国法治化在实事求是的思想路线指引下的思想解放潮流和人类数千年的法治理想中，不断汲取思想化动力。

| Abstract: | Marketing is the basic motive power of the law - based China. Marketing fosters autonomous individuals with lawful and broad activities and more value choices and pluralistic and autonomous social organizitions and bodies, and therefore fosters civil society, which creates an economic force that can restrains the government from its outside and promotes the separation and interaction between the civil society and the political country. Global -izition strenghthens the government s other forces further. The democratical and political construction at the political level and the poltitical system reform are the important factors for the development of a law - based country. Tha law - based China needs to draw thinking and cultural motive power contiunously in the guidance of the "practical and realistical" thought, the emancipation of the mind and the age - old law - based ideal of mankind. |
