论教师的法律地位

摘    要:随着教育体制改革的深入推进,教师已经从原来的"国家干部"队伍中剥离出来而成为了一种专门职业,但教师的法律地位至今仍不明确。教师法律地位的缺失,将涉及教师属性的法律定位,以及教师与政府、教师与学校和教师与学生之间的法律关系。本文以基础教育和高等教育阶段的教师为例,对其法律地位进行了分析,同时就如何保障教师的法律权益提出了若干建议。

On the Legal Status of Teachers

Abstract:As the reform of education system advancing, the teacher has spun off the original "national cadre" team and became aspecialized occupation, but the legal status of teachers is still not clear. The legal status of teachers is very important. The legal position willinvolve the teacher attributes, and the legal relationship between teachers and the government, schools and teachers,teachers and students.This paper will take basic education and higher education teachers as an example, the legal status is analyzed, and puts forward somesuggestions on how to protect the legal rights and interests of teachers.
