| 摘 要： | 具有行政色彩的职教集团作为民事主体在法人制度上具有跨“行政法”与“民法”的双界性,这是职教集团法人治理的症结所在。职教集团法人治理的现实困境突出表现在法律缺失、政府管制以及院校失位等三个方面。职教集团法人治理的实现,需“明确职教集团具备独立的法人主体资格,界定职教集团法人治理的边界;变革政府管理职能,解除职教集团对政府评估权威的路径依赖;建立健全职教集团内部权力运行制约和监督机制,依法进行职教集团章程建设”等。

| Abstract: | As a civil subject,the legal person vocational education group of institutions with administrative color has the double boundaries of“administrative law”and“civil law”in the legal person system,which is the crux of corporate governance of legal person vocational education group of institutions.The practical predicament of corporate governance of public institutions’legal person type vocational education group is mainly manifested in three aspects:lack of law,government regulation and position of colleges and universities.The ways to realize corporate governance of vocational education group include clarifying the qualification of educational group as an independent legal person subject,defining the boundary of the autonomy of educational group legal person,changing government management functions,relieving the dependence of educational group on the authority of government evaluation,establishing and improving the mechanism of restriction and supervision of the operation of internal power of educational group,and building the constitution of educational group according to law. |
