| 摘 要： | 知识产权保护和反垄断法在促进竞争、推动科技创新和促进经济发展、增进消费者福利上是一致的，但知识产权滥用也会阻碍社会竞争、损害社会福利，结果违背立法的初衷。因此反垄断法有必要对知识产权的滥用加以制约。发展中国家在重视知识产权保护的同时，更不能忽视知识产权滥用给经济带来的危害与损失，而应双管齐下，最终实现既保护消费者的利益又促进经济发展的双重目的。

| Abstract: | Intellectual property rights and antitrust law are consistent in accelerating competition, technology innovation,economy development and consumer welfare enhancement. But the abuse of intellectual property rights will counteract competition,spoil community welfare. This is the act of contravening to original intentions.So it is important to constitute antimonopolycontrol on abuse of intellectual property rights. Because develop countries are those who produce knowledge products, whiledeveloping countries are those who consume main knowledge products. So while developing countries protect intellectualproperty rights, they should recognize that the abuse of intellectual property rights would spoil economy, They should realizeboth protect consumer welfare target and accelerate economy development target. |
