| 摘 要： | 医疗损害、医疗过错和医疗损害赔偿范围是审判实践中认定医疗损害赔偿责任的关键问题。医疗损害应当包括医疗事故、医疗差错、与医疗行为相关的其他医疗侵权损害及医疗违约损害；医疗过错的认定应当坚持从客观和主观两方面进行认定；医疗损害赔偿范围的认定应当在坚持相关原则下．明确侵权损害赔偿与违约损害赔偿的范围差别并正确处理赔偿数额的法律冲突。

| Abstract: | Medical damage, medical malpractice and compensation scope are the key issues in the court trial of identification of Liability. Medical damages should cover malpractice, error, breach and related violation. The identification of malpractice should be made from subjective and objective perspectives. The identification of compensation scope should focus on the difference between malpractice and breach and properly handle the legal disagreement on compensation amount. |
