| 摘 要： | 司法理念作为法律文化的重要组成部分，根植于司法活动之中，并直接作用于司法实践，对于维护司法公正、提高司法效率、树立司法权威、发扬司法民主具有重大而现实的指导意义。然而，我国对司法理念问题之研究，尚处于探索阶段，不仅存在一定的理论困惑，诸多实践问题也需要通过理论探索加以突破。从我国司法理念的变迁及现状入手，联系实际查找不足并提出建议，以期对树立中国特色的司法理念有所裨益。
